By browsing this area you are accessing Ipertech, available at www.ipertech.it. Browsing the site and submitting an order imply acceptance of the Terms and of the Data Protection Policies adopted by the site and set out here.

These General Terms and Conditions of Sale apply to the sale of products exclusively in relation to purchases made on the site, in accordance with Part III, Title III, Chapter I of the Italian Consumer Code (Legislative Decree 206/2005, as amended by Legislative Decree 21/2014 and Legislative Decree 70/2003).

Before accessing the products offered on the site, users are required to read these General Terms and Conditions of Sale, which are deemed to be generally and unequivocally accepted at the time of purchase.

Users are invited to download and print a copy of the order form and of these General Terms and Conditions of Sale, the terms of which Ipertech reserves the right to amend unilaterally and without notice.

The site, and therefore the products offered through it, can be used in the following languages: Italian, English and German.

Subject matter

These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on Ipertech. They do not govern the supply of services or the sale of products by parties other than the seller which may appear on the same site through links, banners or other hypertext connections. Before submitting orders and purchasing products or services from other parties, we recommend that you check their terms of sale.

Conclusion of the contract

To conclude the contract you must complete the electronic form and submit it following the relevant instructions.

The form contains a reference to the General Terms and Conditions of Sale, images of each product and the corresponding price, the available means of payment, the delivery arrangements for the products purchased together with the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and the arrangements and time limits for returning the products purchased.

Before the contract is concluded, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and on the processing of personal data.

The contract is concluded when the seller receives the form completed by the user, after verifying that the data it contains is correct.

The user is obliged to pay the price from the moment the online order submission procedure is completed. This occurs by clicking the "Check out" button at the end of the guided procedure. Once the contract has been concluded, the seller takes charge of the order in order to fulfil it.

Registered users

When completing the registration procedure, the user undertakes to follow the instructions given on the site and to provide their personal data correctly and truthfully.

Once registration is complete, the user will receive a confirmation email at the address they provided. Confirmation must be given within a maximum of 2 working days; if confirmation is not given within that period, Ipertech will be released from any obligation towards the user.

Confirmation releases Ipertech from all liability regarding the data provided by the user. The user undertakes to inform Ipertech promptly of any change to the data they have communicated.

If the user provides inaccurate or incomplete data, or if payments made are disputed by the parties concerned, Ipertech may decline to activate the service or suspend it until the shortcomings are remedied.

When a user first requests the activation of a profile, Ipertech assigns them a username and a password. The user acknowledges that these credentials constitute the system for validating their access to the Services and the only means of identifying them; acts carried out through that access will be attributed to them and will be binding on them.

The user undertakes to keep their access data confidential, to look after it with due care and diligence, and not to transfer it to third parties, even temporarily.

Product availability

Product availability refers to actual availability at the moment the user places the order. That availability must in any case be regarded as purely indicative, because several users may be on the site at the same time and products may be sold to other customers before an order is confirmed.

Cases of partial or total unavailability may also arise after the order confirmation email has been sent. In that event the order will be adjusted automatically by removing the unavailable product, and the user will be informed immediately by email.

If the user requests cancellation of the order, thereby terminating the contract, Ipertech will refund the amount paid within 14 days from the moment Ipertech became aware of the buyer's decision to terminate the contract.

Products offered

Ipertech sells consumer electronics and household appliances. The full range is set out on our site at www.ipertech.it.

Payment methods and prices

The price of the products is the price shown on the site from time to time, except where there is an obvious error. In the event of an error, Ipertech will notify the buyer as soon as possible, allowing them either to confirm the order at the correct amount or to cancel it. Ipertech is in no case obliged to supply the goods sold at the lower price shown in error.

Prices on the site include VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which an order confirmation has already been sent.

Once you have selected the products you want, they are added to the basket. You then simply follow the purchase instructions, entering or checking the information requested at each step of the process. Order details can be changed before payment.

Payment can be made by Visa, Mastercard, American Express, Maestro, Apple Pay, Google Pay, Klarna, Revolut Pay and bank transfer.

Delivery

Ipertech ships within Italy only, as set out in the Shipping Policy. International shipping and collection at our premises are not available.

Ipertech delivers only to the address provided by the user at the time of purchase.

Delivery normally takes place within 2-4 working days (1-2 working days of order preparation plus 1-2 working days in transit) or, where no delivery date is specified, within the period estimated when the delivery method is selected, and in any case within a maximum of thirty days from the date of confirmation.

If delivery cannot be made, the order will be returned to the depot. In that event a notice will state where the order is being held and how to arrange a new delivery.

If you are unable to be present at the delivery address at the agreed time, please contact us again to arrange a new delivery date.

If delivery cannot take place for reasons not attributable to us within thirty days of the date on which the order became available for delivery, we will assume that you intend to terminate the contract.

As a result of termination, the amounts paid will be returned, including delivery costs but excluding any additional costs arising from the choice of a delivery method other than the standard method offered, without undue delay and in any case within 14 days of the date of termination of the contract. Transport arising from termination of the contract may involve additional costs, which are payable by the buyer.

Shipping costs are payable by the buyer and are shown explicitly when the order is placed.

Severability

If any clause of these General Terms and Conditions of Sale is void for any reason, this will in no case affect the validity and effect of the other provisions set out in these General Terms and Conditions of Sale.

Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by and construed in accordance with Italian law, without prejudice to any overriding mandatory rule of the country in which the buyer is habitually resident. Consequently, the interpretation, performance and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.

Any disputes relating to and/or arising from them must be settled exclusively by the Italian courts. In particular, where the user qualifies as a Consumer, any disputes must be settled by the court of the place where the consumer is domiciled or resident under the applicable law.
